ARCHIVIO DEL DESIGN DEL PRODOTTO ORAFO

L’ADOR, Associazione Designers Orafi, ha istituito l’"Archivio del design del prodotto orafo", un’iniziativa volta a tutelare e salvaguardare i diritti di proprietà e l’impegno creativo sia del designer che dell’operatore orafo: ambedue, infatti, dedicano serietà professionale e contributi economici alla realizzazione di nuovi prodotti, ma spesso il loro lavoro viene vanificato da concorrenti poco scrupolosi che non esitano ad appropriarsi delle idee altrui, causando un evidente danno economico ed esercitando, di fatto, una concorrenza sleale.

L’Archivio è utilizzato dai designers soci dell’ADOR e dagli operatori orafi che, in rapporto di lavoro con i designers stessi, intendano depositare, in busta sigillata, fotocopia degli elaborati oggetto di tutela. Nel momento in cui risulti evidente un’azione d’indebita appropriazione di un’idea, il designer si impegna ad unirsi all’operatore danneggiato al fine di promuovere, con l’appoggio dell’ADOR, un’azione di censura nei confronti del concorrente disonesto.

Questa azione di censura, che ovviamente non può procedere per vie giuridico-legali (a meno che il materiale oggetto di controversia non sia stato depositato o brevettato), viene condotta dall’ADOR, attraverso le pubblicazioni periodicamente diffuse dall’Associazione stessa, oltre ai notiziari delle diverse Associazioni di categoria.

The ADOR, Jewellery-esigners Association, has created the "Records of the goldsmith’s product design" with the aim of protecting and safeguarding the rights of property and the creative work of the designer as well as the goldsmith.

Both of them devote their professionalism to and make economic investments for the creation of new products but their work is often made useless by unscrupulous competitors that take possession of someone else’s ideas and with this unfair competition cause considerable economic losses.

The records con be used by the designers that are members of the ADOR and by the goldsmiths that collaborate with the designers.

They should, in a sealed envelope, a photocopy of the papers to be protected. Should the misappropriation of an idea become known, the designer indertakes to join the goldsmith in starting, with the help of ADOR, an action of censure against the unfair competitor.

This action of censure, that cannot obviously become a legal action (unless the material that is the object of the controversy has been registered or patented), is performed by the ADOR by means of publications that are periodically published by the Association itself as well as through the bulltins of various trade Associations.
